margin-bottom: 20px; margin-left: 0px; margin-right: 0px; margin-top: 20px; padding: 0px; text-align: justify\"\u003e\u003cspan style=\"color: rgb(34, 34, 34)\"\u003e\u003cspan style=\"font-size: 18px\"\u003e\u003cspan style=\"background-color: rgb(255, 255, 255)\"\u003e平等保护，是一个一直在纸面上有规定却在实践中难以落地的原则。在这两次公布的案例中，有的国企一开始就设置不平等条款，比如某大型国企在采购一民企电缆时，竟然约定自己在收到第三方支付的款项后，再向该民企支付货款，将自己收不到第三方款项的风险转嫁给民企。而民企之所以接受这样的条款，在于其相对于国企的弱势地位，基于有的国企在某一领域近乎垄断的地位，民企有时别无选择，一开始就处于不利境地。另外，“国有”身份有时又成为其为违约行为抗辩的理由。公布的案例中，一家拖欠民企货款的国有医院，在法庭上抗辩称其货款来源为财政资金，受财政审批流程限制，因而不应承担违约责任。这种身份上的不平等，有时是个“全链条循环”：从签订合同时加入不平等条款，到履约时延迟怠慢、状况不断，再到担责时以“国有”身份为自己开脱。而法院在面对此类案件时，有时也会有一些法律之外的考量，比如这次发布的唯一一个民事案件，在法律事实并不复杂的情况下，之前的一审二审都做出了对国企有利的判罚，最终由最高法再审改判。最高法评价这一次改判“不仅实现了民营企业家合法权益的救济，更生动诠释了‘平等保护原则’这一产权保护制度的核心要义”。\u003c/span\u003e\u003c/span\u003e\u003c/span\u003e\u003c!--MID_AD_2--\u003e\u003c!--EOP_2--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_2--\u003e\u003cp style=\"background-color: rgb(255, 255, 255); margin-bottom: 20px; margin-left: 0px; margin-right: 0px; margin-top: 20px; padding: 0px; text-align: justify\"\u003e\u003cspan style=\"color: rgb(34, 34, 34)\"\u003e\u003cspan style=\"font-size: 18px\"\u003e\u003cspan style=\"background-color: rgb(255, 255, 255)\"\u003e对罪与非罪的区分，有时更关乎民企的生死存亡，因为民企对其创始人或主要负责人的依赖程度总体上比较高，一旦“上刑”就容易失去核心支撑。对罪与非罪，最高法这次确立了一个重要原则，即对行为人是否有非法占有他人财物的主观故意进行区分，有就是经济犯罪，没有则是经济纠纷。在这一大原则下，刑法对于作为“手段”的一些行为有了更多包容，比如这次改判无罪的一个案例中，民营企业家未交纳完受让的国有商场的全款，就对外分割出租，甚至还伪造了“发改局收到全款”的收条，再审之所以认定其不具有非法占有的主观故意，在于其未造成租户损失，租户虽然被蒙蔽交了租金，但也实际占有使用了商场的商铺。\u003c/span\u003e\u003c/span\u003e\u003c/span\u003e\u003c!--MID_AD_3--\u003e\u003c!--EOP_3--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_3--\u003e\u003cp style=\"background-color: rgb(255, 255, 255);
